The panel in Ponto decided that the order was in the nature of an acquittal, i. e., a ruling on the merits by which the defendant
was discharged from prosecution. See Pratt v. United States, 70 App.D.C. 7, 102 F.2d 275, 279 (1939). Upon reconsideration,
we conclude that the ruling below was, in fact, an acquittal, and for this reason, appeal by the government is prohibited
by the double jeopardy clause of the Fifth Amendment.
